Subscriber Terms and Conditions

By subscribing to or accessing Digital Chameleon elearning courses ("the “Service”"), users ("Users" or "you") agree to be legally bound and to abide by these Terms and Conditions.

Scope of Agreement
Under this Agreement ("Agreement"), Digital Chameleon ("DC", "we", "our" or "us", etc.) furnishes elearning courseware and services (the "Service") to registered/active subscribers or authorized users ("you", "your" or "member") in thirty or ninety day intervals.  You will have access via login for 30 days from purchase date to single modules; and you will have access via login for 90 days from purchase date if you subscribe to the full Introduction to Digital Media course of eight modules.  By accepting the Terms and Conditions when registering or if you use the Service in any way, you agree to be bound by this Agreement. The term "use" means the use and availability of, access to, transmission to or from or any exchange of information or communication in connection with or arising from the Service. This entire agreement between you and us, supersedes prior agreements regarding its subject matter. Whenever new services become available, your use of them will be under this Agreement unless we notify you otherwise. You must comply with any additional terms which apply to third-party content, products, information or other services. We may change this Agreement at any time. By continuing to use the Service, you agree to be bound any new version of the Agreement.

1. Privacy
Digital Chameleon regards customer privacy as an important part of our relationship with our customers. The following privacy policy applies to all Digital Chameleon users, and conforms to Internet privacy standards.

Collection of Information
In order to subscribe to Digital Chameleon elearning products, we may require information from you in order to provide the best service possible. All correspondence may also be collected and stored, particularly in regard to sales, support and accounts, including Email. Any information collected by Digital Chameleon is collected via correspondence from you or your company. This may be via the telephone, Email, mail, fax or directly through our website.

Use of Collected Information
Any details collected from Digital Chameleon customers is required in order to provide you with our products and/or services, and a high level of customer service. Correspondence is recorded in order to provide service references.

Storage of Collected Information
The security of your personal information is important to us. When you enter sensitive information (such as credit card numbers) on our website, we encrypt that information using secure socket layer technology (SSL). When Credit Card details are collected, we simply pass them on in order to be processed as required. We never permanently store complete Credit Card details. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you.

Communications
Digital Chameleon uses personally identifiable information for essential communications, such as Emails, accounts information, and critical service details. We may also use this information for other purposes, including some promotional Emails. If at any time a customer wishes not to receive such correspondence, they can request to be removed from any mailing lists by emailing us at info@digitalchameleon.net.

Third Parties
Digital Chameleon may at its discretion use other third parties to provide essential services on our site or for our business processes. We may share your details as necessary for the third party to provide that service. These third parties are prohibited from using your personally identifiable information for any other purpose. Digital Chameleon does not share any information with third parties for any unknown or unrelated uses.

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Website.

2. Digital Chameleon Security Policy
Digital Chameleon uses the eWAY Payment Gateway for its online credit card transactions. eWAY processes online credit card transactions for thousands of Australian merchants, providing a safe and secure means of collecting payments via the Internet. All online credit card transactions performed on this site using the eWAY gateway are secured payments.

3. Delivery Policy
After ordering online, you will receive an email confirmation from eWAY containing your order details (if you have provided your email address). We will normally confirm receipt of your order within a few minutes of ordering. We will attempt to send your software/license/access code via Email within 2 working days. 4. Refund & Returns Policy
If for any reason you are not completely satisfied with your purchase we will give you a 3-day money-back guarantee from the time you receive the goods. Please email us at info@digitalchameleon.net within that time if you are not satisfied with your purchase so that we can resolve any problems.

5. Pricing Policy
All of our prices are in Australian dollars (AUD) and include GST (Goods and services tax) applicable to subscribers within Australia.

6. Copyright and Limitations on Use
The Service is the property of Digital Chameleon and may only be displayed, formatted and printed for your personal, non-commercial use. You agree not to reproduce, distribute, sell, publish, broadcast, or circulate any information received through the Service to anyone without our prior written consent. You may not post any content from the Service to news groups, mail lists or electronic bulletin boards, without our prior written consent. Copying and/or electronic transmission of any content of the Service is a violation of copyright law.

You also agree that you will not give out log-ins and/or passwords to other users. We reserve the right to cancel any subscription, without refund, if we discover that a member account is being used by more than one person, or if a log-in/password is given to another person.

7. User Comments, Feedback and Other Submissions including Learning Network Posts
All comments, feedback, suggestions and ideas disclosed, submitted or offered to the Service or in connection with your use of this Service (collectively, "Comments"), shall be and remain the exclusive property of the Service. You agree that you will be solely responsible for the content of any Comments you make. In our sole discretion, any Comments we consider offensive, improper or inappropriate, may be modified or deleted, and can, at our discretion, result in immediate termination of your subscription without refund.

8. Failure to Access Service
You agree that we are not responsible for your inability to log-on to the Service, either because of poor Internet connections, incorrect typing of log-ins or passwords, and/or browser incompatibility. We will make every effort to ensure that our servers remain operational with adequate performance and response time. However, there may be times when our servers are down or response time is slow due to power outages, network problems, regular maintenance, or high traffic volumes. You agree that neither we, nor our suppliers, are responsible or liable, for any loss or damage caused by your inability to use or access the Service, whether or not caused in whole or part by our negligence.

9. Indemnification; Governing Law; Jurisdiction
You agree to defend, indemnify, and hold us, our employees, and other representatives harmless from and against all liabilities, damages, claims, actions, costs, expenses (including attorneys fees), in connection with or arising from your breach of this Agreement.

This Agreement is personal to you, and you may not assign your rights or obligations to anyone. We reserve the right to change our Terms and Conditions at any time, without notification. If any provision of this Agreement is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect.
